CHAPTER 15. UTILITIES – WATER AND SOLID WASTECHAPTER 15. UTILITIES – WATER AND SOLID WASTE\Article 3. Water Deposits

Prior to September 1, 2012, every customer applying for water service shall deposit with the City Clerk (or other proper officer) as security for the payment of bills for service rendered by the Water Department against such customer the sum of Fifty & No/100 Dollars ($50.00). Such advance deposit, together with the interest due thereon, may be applied by said city to the payment of any accrued bill or bills due from the customer on discontinuance of service.

The said City of Cottonwood Falls shall pay to the customer making the deposit, interest at the rate determined by the State Corporation Commission on all deposits made after January 1, 1983; such interest to be credited on the first day of January succeeding such deposit, and on the first day of January thereafter, and shall be payable at the Office of the City Clerk in cash on demand of the depositor or alternatively deducted from the customers water bill on the first day of January of each year. Any interest credited shall be subject to call and payment at any time, but shall not draw interest.

If at any time it appears that the existing deposit is not equal to the maximum service being rendered to the customer, the said city may require an additional deposit, and the service to such customer may be discontinued until such additional deposit is made.

After twelve months of continuance service, if the water customer has remained current in payment of charges for water service, the City Clerk shall refund the water customer’s deposit together with any accrued interest thereon to the customer.

The Waterworks Department shall keep a separate account of the date on which a deposit is received, the name of said depositor, the amount of interest credited, interest paid, and the time of closing the account. The fund shall be known as the “Security Deposit Fund.”

On and after September 1, 2012, water customers shall not be required to pay a security deposit for water service but shall pay a connection charge as provided in section 15-302.

On and after September 1, 2012, every customer applying for water service shall pay a connection charge of Fifty and No/100ths Dollars ($50.00) to receive water service.
