ARTICLE 1. BOARD OF HEALTH

It shall be the duty of the mayor to appoint annually, with the approval and consent of the city council, a committee consisting of three, two of whom shall be members of the city council, and one of whom shall be a practicing physician, who shall be known as the Board of Health of the City of Cottonwood Falls, Kansas and whose duties it shall be to examine into and consider all measures necessary to the preservation of the public health in said city, and to see that all ordinances and regulations in relation thereto are observed and enforced.

The Board of Health shall appoint one of its members as secretary, and the secretary shall keep an accurate record of all the acts, rules, regulations and proceedings of said board in a book provided for that purpose.

It shall be the duty of the Board to prescribe rules and regulations to be approved by the Governing Body for carrying out any and all ordinances of the city relating to the public health and vital statistics, and it shall perform all such duties and have such powers as are imposed upon it by the laws of the State of Kansas and the ordinances of the City of Cottonwood Falls, Kansas.

The board of health shall have such meetings as the business thereof may require upon the call of the chairman or by any two (2) members thereof filing a request in writing with the secretary of the board who shall issue a call for such a meeting. Two (2) members of the board shall constitute a quorum. The board may adopt suitable rules for its government and the conduct of its business.

The board of health shall enforce all rules of the State Department of Health and Environment pertaining to the city, and. may adopt such other health rules and regulations not inconsistent therewith and in accordance with the laws of Kansas and city ordinances respecting the accumulation and removal of garbage and trash, the inspection of privies and septic tanks, the prevention or abatement of nuisances, and other conditions affecting the health of inhabitants of the city as may be required from time to time. Copies of all such rules and regulations shall be filed and preserved by the city clerk. The same shall be published in the official city newspaper and shall be effective upon publication.

All licenses, orders and notices authorized to be issued by the Board of Health shall be executed by the chairman and attested by the secretary and a copy filed with the city clerk. The minutes of the Board shall show the proceedings relative thereto. The police chief, sheriff or his deputies, shall serve all notices or orders issued by the Board by the giving of a copy of the order or notice to the person to whom the same shall be directed. The officer shall make his return thereof in writing by filing a copy with the city clerk endorsed to show such service. It shall be the duty of the police chief, sheriff or his deputies to complain against those persons who fail or refuse to comply with the order or notice served as the case may be.

The Board of Health shall make or cause to be made an inspection of the city as often as deemed advisable for the purpose of examining the sanitary conditions of the city. The Board of Health, or any member thereof, or any person acting under the orders of the Board of Health shall have the authority to enter into and examine at any and all times all buildings, lots, and places of all descriptions within the city, for the purpose of ascertaining the conditions thereof so far as the public health may be affected.

All complaints of any such places or conditions shall be referred to the Board of Health for its action thereon and the Board may call upon the police chief, sheriff or his deputies in those cases where the matter complained of is a violation of the ordinances of the city or the laws of the State of Kansas. The Board of Health may condemn and order the destruction of such foods or provisions held for human consumption and may establish quarantine of persons or places as necessary to prevent the spread of contagious or infectious diseases.

Any person violating any lawful rule or regulation of the Board of Health adopted and promulgated as provided by this article shall upon conviction be fined not more than $100.00, or by imprisonment for not to exceed three months, or by both such fine and imprisonment.
